These terms and conditions of use comprise a legal agreement between you and Back at the Ranch/Canyon Creek Investments Co. By proceeding to use this website you agree to be bound by the terms and conditions of this agreement. If you do not agree, please stop using this website. Back at the Ranch reserves the right to revise the terms of this agreement at any time.

DELIVERY POLICY

If you require delivery within our local service area, (i.e. within a 100 mile radius from our Gunnison, Colorado store), your items will be delivered by our truck and our deliverymen. We charge a minimal flat rate per trip (not per item) for white glove delivery which varies by location. Scroll down to the bottom of these page to view our local delivery charges or click here. If you live beyond our local service area your items will be shipped as follows:

LARGE ITEM DELIVERY

If you live beyond our local service area furniture and other large, heavy items, such as large rugs, will be delivered by a freight carrier. If you order more than one item you may receive your order in separate deliveries.

1). Someone must be present to receive the furniture and it is the customer’s responsibility to have the necessary people to carry the furniture into the house and set it up unless you order an upgraded service level such as white glove. 

2). You must inspect your items immediately (before the trucker leaves) and notate any damage to the packaging on ALL COPIES of paperwork and have the trucker SIGN your notations on all copies.  By signing your paperwork without notations you are acknowledging that all items are in good condition and you will not be able to make a claim. Once the bill of lading is signed the customer owns the merchandise and is responsible for any damages.

3). If your items are found to be defective (i.e. not due to shipping damage) please contact us immediately. We will have your items repaired or replaced. Whether an item should be repaired or replaced is at the sole discretion of Back at the Ranch.

4). Deliveries are scheduled Monday through Friday. The carrier will typically schedule a 4-hour delivery window with you and provide curbside delivery.

5). Once you have selected your level of delivery service you cannot change it unless you contact our store directly at 970-641-0727.

6). Additional fees will apply if;

  1. a) your home cannot be accessed by an 18-wheeler,

            b). you refuse delivery

            c). you miss delivery and need to reschedule

            d). you require after hour deliveries, or require exact appointment deliveries.

e). Items stored beyond the allotted holding limit will incur a storage charge, holding limits vary depending on your local agent, please call for more information

By purchasing an item from our website, you authorize Back at the Ranch and/or the freight carrier to assess additional handling fees as necessary.

The customer is responsible for all freight charges and restocking fees if they refuse delivery of furniture items, which will be subtracted from the customers refund when a customer refuses delivery or cancels their furniture order while their merchandise is in transit.

SMALL ITEMS

Smaller items will be shipped via UPS or FedEx Ground Service unless noted otherwise. Shipping times vary depending on the manufacturer and where you are located. If you order more than one item, you may receive your order in separate deliveries.

Back at the Ranch No Hassle Return Policy

Damaged items: Please inspect your item carefully when it is delivered. If you receive your item and it is damaged, please notify us immediately. Back at the Ranch will replace or repair any damaged item at no cost to the buyer as long as we are notified within 5 days after merchandise has been received. Damage must be noted on the bill of lading. Minor imperfections including small cracks, knots, surface markings, and color variations in wood, or scars, brands, etc in top grain leather are normal and are not defects.

If you are not satisfied with the merchandise you purchased from our site, you can return the merchandise within 14 days from the day received and we will refund your money excluding the shipping fee. Restocking fees may apply. If the product was on a free shipping promotion, the purchase price of the product less the shipping charges incurred will be refunded. Refused items will be subject to our Return Policy.

Return shipping is the responsibility of the customer. Please email or call us before returning merchandise to obtain an RMA number and the correct return address for your package. The merchandise must be in excellent, like new condition, in the original packaging, adequately packed and insured before returning.

Custom orders, made-to-order items, special orders, clearance products, and gift certificates are nonrefundable. A 5% processing fee will be deducted from all returns. All sales are final for bedding, custom upholstery, made-to-order case goods, mattresses, Clearance and Closeout items. Final Sale items will not be accepted for return.

Refunds will be issued after the merchandise has been received and inspected by Back at the Ranch.

Cancellations: Any order, including custom and special orders, can be cancelled within 24 hours from placement of the order. After 24 hours our return policy will apply.

Content

Prices, specifications, availability, and terms of offers are subject to change at any time without notice. We make every effort to display as accurately as possible the colors of our products. The actual colors displayed on your computer monitor will depend on your computer, and we cannot guarantee that your display of color will be accurate. Occasionally there may be information that is incomplete, inaccurate or dated or there may be typographical or photo-graphical errors. These errors or any other errors about an item are completely unintentional. If an item is incorrectly priced Back at the Ranch reserves the right to refuse or cancel an order, whether or not the order has been confirmed or your credit card has been charged. If your credit card has been charged Back at the Ranch will refund your card for the amount of the incorrect price of the item ordered.

Ownership of This Website

This website is owned and operated by Back at the Ranch/Canyon Creek Investments Co. All of the content presented or displayed on this website, including, but not restricted to, text, graphics, logos, photographs, images, moving images, sound, illustrations and software (“Content”), is under the ownership of Back at the Ranch/Canyon Creek Investment Co., its licencors and its content providers. The Content may solely be used as a shopping resource. Any other use of the Content, including but not limited to reproduction, modification, distribution, transmission, display or performance, is strictly prohibited.

Disclaimer

This site is provided by Back at the Ranch on an “AS IS” basis. Back at the Ranch makes no representations or warranties of any kind, express or implied, as to the operation of this site. To the full extent permissible by applicable law, Back at the Ranch disclaims all warranties, including but not limited to the implied warranties of merchant-ability and fitness for a particular purpose. Back at the Ranch will not be liable for any damages of any kind arising from the use of this site, including but not limited to, direct, indirect, incidental punitive and consequential damages.

Governing Law and Venue

This Agreement shall be interpreted, construed and governed by the laws of the State of Colorado USA. Venue for all disputes arising under this Agreement shall lie exclusively in the District Courts of the State of Colorado in Gunnison County or the Federal District Courts of the State of Colorado.

We reserve the right to change these Terms and Conditions of Use, the Privacy Policy, prices, information and available contractual license terms featured on this website without notice.
